Federal Court of Appeal Rules in Med-Emerg Complaint: Calian

Calian Technologies reports that the Federal Court of Appeal released its determination regarding the application for judicial review filed by Med-Emerg International Inc. with respect to the Canadian International Trade Tribunal (CITT) ruling on procurement by the Department of Public Works and Government Services (PWGSC), on behalf of the Department of National Defence, for the provision and management of a workforce of qualified health service providers.

The Federal Court of Appeal dismissed the application for judicial review and upheld the CITT decision. Med-Emerg submitted five allegations of error for the Court to find a basis for intervention. The Court found no basis for intervention on any of the five allegations and accordingly dismissed the application for judicial review. The Federal Court of Appeal also denied the application by Med-Emerg for the award of additional costs. Both PWGSC and Calian have been awarded their respective costs regarding the appeal.

The Kanata, ON-based company says it will now focus its efforts on the civil action brought against it by Med-Emerg with respect to this contract and will vigorously defend the claim, including the basis of the claim and the amounts being sought.
